Man fired immediately after filing for Workers’ Compensation.


Employee Files a Complaint against Neville Galvanizing for Disability Discrimination

Timothy, a former worker with Neville Galvanizing, spent most of his time doing manual work for his job. He filed, painted, and lifted heavy loads from 50-150 pounds. Two years into the job, Timothy’s arms radiated with extreme pain, causing him daily agony. Timothy’s doctor diagnosed him with Carpal Tunnel Syndrome, stemming from the repetitive lifting of heavy loads at work.

Despite this diagnosis, Timothy chose to continue to work for a few months without notifying his company. The growing intensity of the pain finally prompted Timothy to inform Neville Galvanizing of the work-related condition, and they scheduled him for “light duty.” To improve his mobility, Timothy tried all treatments except for surgery, but nothing helped. Surgery was his final and only option.

Timothy notified Neville Galvanizing that he needed surgery and requested FMLA leave to recover. Unable to pay for the surgery on his own, Timothy filed a claim for his rightful Workers’ Compensation. On that same day, Timothy was fired, immediately after allegedly filing the Workers’ Compensation claim.

It can’t be clearer that Neville Galvanizing discriminated against Timothy when they fired him after he required surgery and Workers’ Compensation. The law gives Timothy a right to Workers’ Compensation without losing his job. Neville Galvanizing’s actions are wrong and illegal, but they deny the claims. KM&A strives to protect employee rights by challenging employment discrimination.
