KM&A Files Lawsuit Against UPMC Presbyterian Hospital

Employee Files a Complaint against UPMC Presbyterian Hospital for Age Discrimination

Long-time nurse suspects age prejudice when she seeks promotion and continues to be passed over for younger, less experienced candidates.

Pittsburgh, PA, June 12, 2017 – Kraemer, Manes & Associates LLC “KM&A” has filed a complaint for age discrimination against UPMC Presbyterian Hospital, for the Western District of Pennsylvania.

A woman, employed for over 20 years with the UPMC Presbyterian Hospital, applied for a position that was open to current employees and graduates. In total, Plaintiff submitted 35 applications for the position that would be a promotion from her current job. While Plaintiff was passed over, two co-workers in their 20s received the open positions within two weeks of application.

Plaintiff approached the interviewer and asked why she’d been passed over when she had the qualifications and experience required for the position. The interviewer responded, “This is not our choice and that decision is not in our hands.” This statement ridicules the interviewing process and shifts blame since interviewers do heavily bias the final decision.

Furthermore, approximately two years ago, the UPMC Presbyterian Hospital offered all full-time and over 62-year-old employees the monetary compensation of $15,000 for voluntary retirement. Clearly, the hospital pressured employees of a certain age to leave.

UMPC Presbyterian Hospital’s failure to offer the position to a qualified and experienced applicant of a certain age reveals an underlying problem of age prejudice.
