Kraemer, Manes & Associates LLC filed suit against Sodexo, Inc. on behalf of Henry Gaston, Alfred Sadik, and Sharrone Harris. The complaint alleges that on their applications to work for Sodexo at the University of Pittsburgh location, Mr. Gaston, Mr. Sadik, and Mr. Harris indicated that they were not convicted of a crime within the period stated on the application, which was accurate for Mr. Gaston, Mr. Sadik, and Mr. Harris. The complaint alleges that a background check in 2012, years after they had begun working for Sodexo indicated convictions for the three, all which were at the time of their application beyond the time period indicated on the application. The complaint alleges that at the time of termination by Sodexo, the convictions were 30, 25, and 15 years ago.
The complaint alleges that that Sodexo’s employment practices disparately impacted African American employees, that Mr. Gaston, Mr. Sadik, and Mr. Harris were terminated in violation of Title VII of the Civil Rights Act of 1964, the Pennsylvania Human Relations Act, and the Pennsylvania Criminal History Record Information Act.
