Kraemer, Manes & Associates LLC “KM&A” has filed a complaint against Heart 2 Heart and Toni Duncan in the United States District Court for the Western District of Pennsylvania.
The complaint alleges that Plaintiff was retaliated against in violation of Pennsylvania’s Whistleblower Law and for refusing to engage in illegal activity. Plaintiff also alleges that she was denied due compensation after being terminated and a number of defamatory statements were made against her by Defendants. After an incident with a client, Plaintiff wrote up a negligence report as required by State law. Her employer asked her to falsify the report and forge documents. When Plaintiff refused and filed a correct report, she was terminated. After her termination Defendants began leveling a number of false allegations against the Plaintiff. Defendant’s also refused to compensate Plaintiff for her final time with the company.
