Employee Thinks Termination Occurred Because She Filed for Workers’ Compensation

Employee Files Lawsuit against Yogi Bear’s Jellystone Park Camp Resort for Retaliation

Gina worked the in-season as a food service manager and the off-season as a registration clerk at Yogi Bear’s Jellystone Park Camp Resort. In mid-October 2015, while at work, Gina lifted a box and twisted, causing a back injury. She couldn’t finish work so Gina informed her supervisor about the situation and went home for the day.

Upon returning to work the following day, Gina completed the Employee’s Report of Injury form, outlining the details of the accident and injury. She then pursued medical attention. Her doctor prescribed physical therapy, and Gina began treatment. Despite the care, Gina struggled to perform any physical task related to her job and her supervisor permitted her to limit her physical activity. However, according to Gina, no formal reduction of her job duties or title was made.

Gina followed up with her supervisor about her worker’s compensation claim, and her supervisor allegedly informed her that the general manager was working on it. But then, at the end of November, the general manager called Gina and fired her. She was told that the reason behind her termination was being late to work and having disputes with coworkers.

But, Gina suspects that her termination occurred due to her workers’ compensation claim. Although her employer claims to have submitted her workers’ compensation claim, Gina doesn’t believe this to be true. In fact, Gina found out that as of 2016 the Pennsylvania Bureau of Workers’ Compensation has no record of her work-related surgery. She believes that her employer terminated her to retaliate against her for asserting her right to workers’ compensation.
