Employee Files Lawsuit against Phoebe Home for Age Discrimination

Michelle started working for Phoebe Home in March 1999. Years later, when Michelle was 48 years old, the company began to close down buildings and reduce residents. The company encouraged many older employees to accept early retirement. Michelle chose not to accept the offer of early retirement.

Around this time, Michelle noted that employees who had been with the company for 20+ years and were older than 40 years old were being terminated. During the last few months there, Michelle remembered that she was written up for inconsequential and false problems. She shared that she was written up for a late delivery of medications when the pharmacy delivered them late, for a false accusation of administering medications, for a typo error that wasn’t hers, and for signing off medications but she wasn’t on shift.

In February 2017, Michelle was placed on a Performance Improvement Plan (PIP) for three months. According to Michelle, the three supervisors who monitored her PIP never told her any performance issues. After the three months were completed, Michelle was informed she would be terminated due to performance-related issues found during a private audit of her results. When Michelle pressed for information, her manager refused to share any more information.

Soon after, Michelle shared that a fellow coworker admitted to seeing management level employees pouring over Michelle’s file, allegedly trying to find a reason to fire her. Michelle believes that she was fired due to her age. As a client of KM&A, Michelle stands up for her employee rights.
