Black Employee Allegedly Disciplined While Non-Black Coworkers Are Not.


Employee Files Lawsuit against Sikorsky Aircraft Corporation for Race Discrimination

When Tracy was hired by Sivorsky Aircraft Corporation as a senior quality control engineer, it didn’t take him long to realize he was the only black employee at his location. Before he finished his first year, his new supervisor of two months placed Tracy on an Evaluation Improvement Plan (EIP). Tracy shared that he couldn’t believe his supervisor of only two months had deemed it necessary to place him on an EIP.Tracy shared that he couldn’t believe his supervisor of only two months had deemed it necessary to place him on an EIP.

Tracy’s supervisor allegedly wrote in the EIP that Tracy was unprofessional in daily meetings, submitted reports with typographical errors, arrived late to meetings, and did not perform at the same level as peers. Tracy was surprised that his supervisor could accuse him of so much regarding the meetings since the supervisor had only ever attended one meeting within her two months. Tracy analyzed his own actions; he checked his reports, revealing only one report with a typographical error. Additionally, his lateness and absence for meetings only occurred when he had been assigned to another high priority task by his supervisor or manager. In comparison, according to Tracy, his non-Black coworkers were constantly late for lesser reasons and routinely turned in reports with many mistakes. These non-Black coworkers were not placed on an EIP like Tracy.

Three months later, Tracy received his annual performance review. The review was so full of negative comments that he filed a complaint with Sikorsky. But, Tracy shared that nothing was done. The following month, Tracy tried to speak up in a meeting, but a coworker interrupted him, scoffing, “See. This is what I was talking about.” Disheartened by the continued discrimination, Tracy again filed a complaint about the race-based discrimination to the manager-level. Three days later, Sikorsky terminated Tracy.

Although racial discrimination can be subtle, Tracy noted time and time again when he was treated differently than non-Black employees. No employee should deal with racial discrimination.
